HOW DOES CHILD CUSTODY WORK IN TEXAS?
In Texas, child custody involves two issues: conservatorship and possession. Conservatorship refers to each parent’s rights to make decisions about the child’s health, religion, education and general welfare. Typically, courts will presume that both parents can share in this role, serving as Joint Managing Conservators. In some unusual situations, such as when there is a history of family violence, one parent may serve as a Sole Managing Conservator.
In family law, the word possession refers to when and under what circumstances you each have possession of your child or children. Generally, parents will either agree on a possession schedule or the court will develop a parenting schedule. While these concepts are fairly straightforward, creating a sensible arrangement can be complex, and in most cases involves considering factors that you have never had to anticipate before. Moreover, litigation in child custody disputes can be stressful, uncertain and expensive. Whenever possible I try to help my clients resolve their differences through thoughtful negotiations, mediation and collaborative law. Of course, when there is no reasonable alternative to litigation, I am prepared to be a strong advocate for you and your children.
